Two Engineers Bring Class Action Lawsuit Against OpenAI, Microsoft

A product engineer and a software engineer are bringing OpenAI and its primary supporter Microsoft to San Francisco federal court with claims of stolen personal data, Reuters reported on September 6.

What is the OpenAI class action lawsuit?

The plaintiffs, who are known only as A.T. and J.H. in the complaint, claim OpenAI used their personal information scraped from the internet to train generative artificial intelligence tools, such as ChatGPT. Specifically, it claims OpenAI used personal data from social media, stealing their “skills and expertise” in order to make products that could “someday result in [their] professional obsolescence.”

The plaintiffs request that OpenAI and Microsoft make meaningful safeguards against the use of private data and add ethical guardrails. The plaintiffs also asked for an unspecified amount of money in damages.

According to the complaint, OpenAI can “unlawfully obtain access to and intercept this information [everything from physical location to keystrokes] from the individual users of applications and devices that have integrated ChatGPT-4.”

“Plaintiff J.H. reasonably expected that the information that he exchanged with these websites prior to their introduction would not be intercepted by any third party looking to compile and use all his information and data for commercial purposes,” the complaint reads.

The latest legal action brought against OpenAI and Microsoft

This is the second lawsuit to cover some of the same ground. In June, the Clarkson Law Firm brought a similar complaint against OpenAI and Microsoft. The September complaint, filed by the personal injury firm Morgan & Morgan, quotes extensively from the complaint made in June.

Creative writers have brought lawsuits against OpenAI for scraping and profiting off of their writing through incorporating it into the massive amount of data on which a generative AI model is trained.

For example, comedian Sarah Silverman sued OpenAI and Microsoft for copyright infringement in July, and authors Mona Awad and Paul Tremblay filed a suit against OpenAI in July for allegedly training ChatGPT using their books.

In August, the New York Times revealed it was considering suing OpenAI to maintain intellectual property rights to the newspaper’s articles. The Times and OpenAI had originally been in talks regarding OpenAI paying the newspaper to use its content in AI tools. However, according to NPR’s anonymous sources, the conversation became a high-profile fight over how generative AI should be allowed to use writers’ original work.

OpenAI’s shifting priorities and Microsoft’s involvement

The complaint notes a change in OpenAI’s stated goals around 2019, when it switched from a nonprofit dedicated to AI research to a for-profit, commercial model.

OpenAI was founded in 2015 with a stated goal of “advanc[ing] digital intelligence in the way that is most likely to benefit humanity as a whole, unconstrained by a need to generate financial return.”

Microsoft entered the mix in 2016, when the Redmond tech giant joined on a plan to “democratize” AI technology. OpenAI has shifted to a for-profit model as of March 2019 to try to raise more funds. Subsequently, OpenAI entered a partnership with Microsoft specifically to develop artificial general intelligence (theoretical human-level intelligence). Since then, Microsoft has invested billions in the AI company in support of a variety of products and platforms.

Apple is reportedly throwing millions of dollars a day into AI development

Apple is notorious for playing the long game by releasing features and capabilities that other companies already offer but marketing them with an innovative twist to make them appear unique. Artificial intelligence is one of the ways the company continues playing the long game. Almost a year after other major players released their AI tools, Apple is now reportedly spending millions of dollars a day on AI development.

Google and Microsoft jumped onto the generative AI bandwagon just weeks after OpenAI released ChatGPT, each one releasing its own AI chatbot to rival the latter, Bard and Bing.

Months after these AI chatbots have grown in popularity and controversy, The Information reports that Apple is working on several artificial intelligence models. The tech giant sees generative AI as an area of growth and an opportunity to compete with major companies like Amazon, Google, and Meta, which have foundational models.

Apple has several teams working on different AI models, including an image generation model, a multimodal model to handle both text and visual data, and a conversational AI unit manned by John Giannandrea, the senior vice president of Machine Learning and AI Strategy, who was originally hired to improve Siri.

The Information also reports that these models could automate tasks through Siri and serve as AI customer service chatbots for AppleCare.

Apple's largest foundational model, 'Ajax GPT', is reportedly more powerful than OpenAI's GPT 3.5, which powers the free version of ChatGPT. Ajax GPT is said to have over 200 billion parameters, while GPT 3.5 has about 175 billion parameters.

Large language models are expensive to train, resulting in steep costs for hardware and data that goes into GPUs and TPUs and massive dataset storage. This also incurs high energy bills as these systems consume a lot of power. All this, added to the time and expertise needed to fine-tune these machine learning models, results in an expensive endeavor, and Apple is paying the price — literally.

Apple's hefty investment into generative AI has been kept under wraps, as the company hasn't officially made any announcements or confirmations on its progress.

AI reading coach startup Ello raises $15M to bolster child literacy Lauren Forristal 7 hours

Ello aims to eradicate childhood illiteracy by leveraging artificial intelligence and child speech recognition technology. The startup announced today that it secured $15 million in Series A financing to help it do so, and the funding will go toward product development and expanding access to consumers.

“Ello is one of those great companies,” Coddy Johnson, partner at lead investor Goodwater Capital told TechCrunch. “We were drawn to the proprietary and radical leaps that the Ello team has made – and continues to make – in AI technology to enable 1:1 tutoring for kids, which research has long shown to be the most effective learning approach.”

Ello is a subscription-based service aimed at kids from kindergarten through Grade 3 that delivers five books every month for $24.99. Parents download the Ello app, which determines the child’s reading level through a series of questions. It also asks about their interests – including animals, arts & crafts, sports and science. Reading experts then hand-select books for each child. Additional kids can be added to a family account at $12.49 per month per child. While it’s exclusively a tablet app for now, the startup is working on bringing it to smartphones, too.

Using its proprietary technology, Ello listens to the child read out loud and analyzes their speech to correct mispronunciations and missed words. Like a real teacher, the AI reading coach waits until the child has finished reading the page before using phonics-based strategies to teach them critical reading skills. Kids can also tap on the question mark icon if they want extra help.

“Ello is the patient reading companion that every parent wishes they could be– even in those moments of frustration,” co-founder and Chief Experience Officer Dr. Elizabeth Adams told us. Adams is a clinical psychologist who specializes in child development and child behavior.

The app also features gamification mechanics, so that as the child progresses each month, the app collects points, which can be exchanged for toys and prizes.

Ello was founded in 2019 by Adams and CEO Tom Sayer, the former head of impact and adoption programs at Google for Education. The third co-founder is engineer Catalin Voss, who was a PhD candidate in AI at Stanford University. Voss has also co-founded and sold two machine-learning startups, DukaConnect and Sension.

In March 2020, Ello launched through Y Combinator as a service to partner with parents around their child’s development. However, after speaking with hundreds of parents, the founders discovered that the pandemic severely impacted how children were learning how to read.

According to a 2021 study from Stanford University, reading fluency among second- and third-graders in the U.S. was about 30% behind what would be anticipated in a typical year at the time.

Adams even experienced this problem with her own daughter, who found it difficult to learn how to read over Zoom. “We thought it was an important moment where we could build something better,” she said.

Ello is different than other ed-tech companies, Adams explained, because it isn’t assessment-based and doesn’t show progress markers. A similar startup, Amira Learning, launched an AI reading assistant in 2018, however, but that one’s specifically aimed at educators, rather than for at-home use like Ello.

“Ello doesn’t check for comprehension,” she said. “We’re really focused on engagement and the child’s love for reading and growing that confidence…We give children an experience that is based on learning, but also delightful and doesn’t feel like a test.”

The company claims its AI reading coach outperforms OpenAI’s Whisper and Google Cloud’s speech API. In terms of traction, the company says 10,000 families use Ello, and children have read over 100,000 books on the app.

On the long-term roadmap, Ello intends to partner with schools in the near future and develop a product specifically designed for classrooms. The company is running pilot programs with about 30 schools, mostly in San Francisco and New York.

“A teacher’s pain point is different than a parent’s,” Sayer said. “Teachers really want that assessment data. So, we want to make sure we’re building that into the tool.”

While Sayer declined to provide specifics around the product roadmap, he mentioned that the company is currently integrating generative AI into its app. Also in the pipeline, the company plans to launch versions of Ello in other languages. Ello is currently testing a German version.

“One of the great things about self-supervised learning, which is the underlying technology that our speech recognition is built on, is that it’s much easier to counter-bias and we’ve actually put in a lot of effort to rigorously evaluate the performance of our models across different demographics, whether that’s different ethnicities, ages, genders, children with specific learning needs… when we see a disparity, we can actively correct that in a much more easy manner,” Sayer added.

In addition to Goodwater Capital, the round included participation from Reed Hastings, Common Sense Growth, Homebrew and Ravensburger.

Building Microservice for Multi-Chat Backends Using Llama and ChatGPT

Microservices architecture promotes the creation of flexible, independent services with well-defined boundaries. This scalable approach enables developers to maintain and evolve services individually without affecting the entire application. However, realizing the full potential of microservices architecture, particularly for AI-powered chat applications, requires robust integration with the latest Large Language Models (LLMs) like Meta Llama V2 and OpenAI’s ChatGPT and other fine-tuned released based on each application use case to provide a multi-model approach for a diversified solution.

LLMs are large-scale models that generate human-like text based on their training on diverse data. By learning from billions of words on the internet, LLMs understand the context and generate tuned content in various domains. However, the integration of various LLMs into a single application often poses challenges due to the requirement of unique interfaces, access endpoints, and specific payloads for each model. So, having a single integration service that can handle a variety of models improves the architecture design and empowers the scale of independent services.

This tutorial will introduce you to IntelliNode integrations for ChatGPT and LLaMA V2 in a microservice architecture using Node.js and Express.

Chatbot Integration Options

Here are a few chat integration options provided by IntelliNode:

  1. LLaMA V2: You can integrate the LLaMA V2 model either via Replicate’s API for a straightforward process or via your AWS SageMaker host for an additional control.

LLaMA V2 is a powerful open source Large Language Model (LLM) that has been pre-trained and fine-tuned with up to 70B parameters. It excels in complex reasoning tasks across various domains, including specialized fields like programming and creative writing. Its training methodology involves self-supervised data and alignment with human preferences through Reinforcement Learning with Human Feedback (RLHF). LLaMA V2 surpasses existing open-source models and is comparable to closed-source models like ChatGPT and BARD in usability and safety.

  1. ChatGPT: By simply providing your OpenAI API key, IntelliNode module allows integration with the model in a simple chat interface. You can access ChatGPT through GPT 3.5 or GPT 4 models. These models have been trained on vast amounts of data and fine-tuned to provide highly contextual and accurate responses.

Step-by-Step Integration

Let’s start by initializing a new Node.js project. Open up your terminal, navigate to your project’s directory, and run the following command:

npm init -y

This command will create a new `package.json` file for your application.

Next, install Express.js, which will be used to handle HTTP requests and responses and intellinode for LLM models connection:

npm install express    npm install intellinode

Once the installation concludes, create a new file named `app.js` in your project’s root directory. then, add the express initializing code in `app.js`.

Llama V2 Integration Using Replicate’s API

Replicate provides a fast integration path with Llama V2 through API key, and IntelliNode provides the chatbot interface to decouple your business logic from the Replicate backend allowing you to switch between different chat models.

Let’s start by integrating with Llama hosted in Replica’s backend:

Llama V2 Integration Using AWS SageMaker

Now, let’s cover Llama V2 integration via AWS SageMaker, providing privacy and extra layer of control.

The integration requires to generate an API endpoint from your AWS account, first we will setup the integration code in our micro service app:

The following steps are to create a Llama endpoint in your account, once you set up the API gateway copy the URL to use for running the ‘/llama/aws’ service.

To setup a Llama V2 endpoint in your AWS account:

1- SageMaker Service: select the SageMaker service from your AWS account and click on domains.

2- Create a SageMaker Domain: Begin by creating a new domain on your AWS SageMaker. This step establishes a controlled space for your SageMaker operations.

3- Deploy the Llama Model: Utilize SageMaker JumpStart to deploy the Llama model you plan to integrate. It is recommended to start with the 2B model due to the higher monthly cost for running the 70B model.

4- Copy the Endpoint Name: Once you have a model deployed, make sure to note the endpoint name, which is crucial for future steps.

5- Create Lambda Function: AWS Lambda allows running the back-end code without managing servers. Create a Node.js lambda function to use for integrating the deployed model.

6- Set Up Environment Variable: Create an environment variable inside your lambda named llama_endpoint with the value of the SageMaker endpoint.

7- Intellinode Lambda Import: You need to import the prepared Lambda zip file that establishes a connection to your SageMaker Llama deployment. This export is a zip file, and it can be found in the lambda_llama_sagemaker directory.

8- API Gateway Configuration: Click on the “Add trigger” option on the Lambda function page, and select “API Gateway” from the list of available triggers.

9- Lambda Function Settings: Update the lambda role to grant necessary permissions to access SageMaker endpoints. Additionally, the function’s timeout period should be extended to accommodate the processing time. Make these adjustments in the “Configuration” tab of your Lambda function.

We built a microservice empowered by the capabilities of Large Language Models such as Llama V2 and OpenAI’s ChatGPT. This integration opens the door for leveraging endless business scenarios powered by advanced AI.

By translating your machine learning requirements into decoupled microservices, your application can gain the benefits of flexibility, and scalability. Instead of configuring your operations to suit the constraints of a monolithic model, the language models function can now be individually managed and developed; this promises better efficiency and easier troubleshooting and upgrade management.

Microsoft to reveal AI plans for OneDrive in October event

Microsoft is hosting an online event about OneDrive and AI

Microsoft is infusing OneDrive with a dose of AI and will host an online event to describe how this move will play out. Earlier this week, the company announced a OneDrive event slated to take place on Tuesday, October 3, at 1pm ET.

Dubbed "Microsoft OneDrive: The Future of File Management is Here," the event will highlight new enhancements to the file storage service and offer a "sneak peek" at how AI will fuel new search, sharing, and queries for your files.

Geared toward IT admins, partners, and Microsoft 365 enthusiasts, the event will offer presentations from five Microsoft executives: Jeff Teper, President for Collaboration Apps & Platform; Arwa Tyebkhan, Principal Group Product Manager; Gaia Carini, Principal Group Product Manager; Jason Moore, VP Product Management; and Sesha Mani, Partner Group Product Manager.

Teper leads the product, design, and engineering teams for Microsoft 365, including Teams, SharePoint, OneDrive, and other apps. Tyebkhan is the principal group product manager for OneDrive with a focus on the OneDrive Web product. Carini is the principal group product manager for OneDrive Sync on Windows and macOS. Moore is a VP of product management for OneDrive, SharePoint, Microsoft Lists, and Office 365. And Mani is the product head for Microsoft 365 Cloud Security, AI, and Management.

Following the event, Microsoft will open the floor to questions in a live chat-based Q&A. Interested participants can add the event to their calendar and follow a link to join the event via Microsoft Teams when it kicks off.

"In recent months we've made many enhancements to OneDrive and there's more to come," Microsoft touted in its announcement. "Don't miss this opportunity to learn what's new and discover how OneDrive can help you and your organization achieve more."

As AI has grabbed worldwide interest and attention, companies have been rushing to capitalize on the technology. Major players such as Google and Microsoft have been devising new AI-powered products and adding AI to existing applications and services. Microsoft has been touting its AI-enabled Bing search and chatbot, integrating its new Copilot AI into Windows and Microsoft 365, and adding AI to its mobile apps.

With AI in the air, this Fall promises to be a busy time for Microsoft. The company is also hosting a special event in New York City on September 21 in which it's expected to unveil new Surface products, including two-in-one models, laptops, and accessories. But AI will also be a presence. Yusuf Mehdi, Microsoft's Corporate VP & Consumer Chief Marketing Officer, confirmed that the company will share more about its AI innovations at this event.

And what of OneDrive? Over the years, Microsoft has updated the service with minor tweaks. But OneDrive hasn't seen any buzzworthy advancements that truly improve how it works or how people use it.
